New Mexico has no legal recreational program but has legalized medical marijuana in 2007. In July 2019, decriminalization went into effect thanks to bill 323. This reduced the penalty for possession to a simple $50 fine. It also decriminalized drug paraphernalia, being the first of the states to do so. The bill passed the legislature easily by a house vote of 44-20 and through the senate at 30-8. Wide margins and no real resistance.

Medical use was legalized in 2007 through a bill signed by then-Governor Bill Richardson. A 1978 law also allowed for medical use but only through a federally-approved research program. It was the first medical cannabis law enacted by any state.
